1. ELIGIBILITY. Each Participant in the Promotion must be an active promotional products distributor company.
The following parties are not eligible to participate:
(a) Any employee of CORVEST or any of its parents, subsidiaries, affiliates, or agents (including any agency
or other company involved in the development or execution of the Promotion or production or distribution of
Promotion materials) (a "Covered Employee”).
(b) Immediate family members (i.e., spouse, parents, guardian, grandparents, aunts, uncles, nieces, nephews,
siblings, children, mother-, father-, brother-, or sister-in-law, or step-father, step-mother, step-brother, or step-sister),
domestic partners, co-habitants, household members, or employees of any Covered Employee.
(c) Anyone not at least 18 years old on June 1, 2009.
(d) Any entity not headquartered in the United States (if an individual, anyone not a resident of the United
States).
(e) Any promotional products supplier company (other than CORVEST) and any employee of such company.
2. DURATION. Subject to these Official Rules, the Promotion shall be in effect from June 1, 2009 to August 31, 2009 (inclusive). All codes not redeemed by August 31, 2009 shall be null and void. All prizes not applied by August 31, 2009 to a purchase order from CORVEST shall be forfeited as null and void.
3. HOW TO PARTICIPATE IN THE PROMOTION. Participants who redeem a valid redemption code shall
receive a "promo” code that may be applied to any eligible purchase from CORVEST.
(a) How To Obtain Redemption Codes. Redemption codes will be provided via direct mail, industry publication
advertisements, and promotional emails. You may also contact CORVEST customer service at 800-523-0825 to
request a redemption code.
4. HOW TO CLAIM YOUR PRIZE. All prizes must be applied to a purchase order made on or before August 31, 2009. Purchase orders may be made by telephone at (800) 523-0825, by email at orders@corvest.com, by fax at (800) 446-4329, or online at www.corvest.com. You must present your promo code at time of order; the promo code must also be included on your purchase order. At the time of your order, the claimant's name and the proffered redemption code will be compared to results as reported by the Promotion's web application/ database to validate proof of winning.
5. PRIZES AND CONDITIONS. Each promo code will entitle the Participant to any one of the following prizes, which may be chosen by CORVEST based on any factor(s). All Prizes are subject to the specific conditions shown below, as well as all general conditions provided elsewhere in these Official Rules. The number of prizes awarded is dependent on the number of Participants in the Promotion.
6. GENERAL CONDITIONS FOR ALL PRIZES AND PROMO CODES.
(a) Prizes and promo codes may not be exchanged for any cash and are non-transferable and non-divisible.
Promo codes are valid on any Adva-Lite®, Toppers®, and It's All Greek to Me® active catalog items that are
in-stock at the time the purchase order is processed by CORVEST.
(b) Unless otherwise specified, each promo code may be used only once per Participant. Promo codes and prizes
are not valid with any offer, coupon, discount, credit, or other promo code or prize. Unless otherwise specified,
discounts apply only to cost of items (i.e., not to shipping & handling, tax, or any other fee or charge). Offers
good on decorated orders at catalog quantities only. Promo code must be included on purchase order to receive
special pricing. Additional charges may apply. All Participants are solely responsible for all taxes, permits, and
other fees associated with prize receipt.
7. LIMITATION OF LIABILITY. To the fullest extent permitted by applicable law, CORVEST and its parents, subsidiaries, affiliates, agents and agencies, and each of their respective officers, directors, employees, successors, assigns, and agents assume no responsibility and shall not be liable for: (a) the non-availability, loss, interception, or interference with, late receipt or damage of or to any promo code, prize claim, promotional materials, prize, or notification or other communication; (b) any representation, warranty, condition or guarantee in respect of a prize; (c) any taxes, fees, charges or other costs which Participants may be required to pay at any time in connection with a prize; (d) any incorrect or inaccurate information (whether or not caused by any Participant) caused by printing errors or by any of the equipment or programming associated with or utilized in connection with the Promotion; (e) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (f) unauthorized human intervention in any part of the entry process or the Promotion; (g) technical or human error which may occur in the administration of the Promotion or the processing of entries; (h) any damage, delay, harm, violation, non-performance, or nonenforcement of any of these Official Rules caused by, directly or indirectly, any condition or cause reasonably beyond CORVEST's control, including but not limited to any act of nature, law, regulation (or other governmental restriction), economic recession or depression, war, invasion, act of terrorism, natural or man-made disaster, insurrection, riot, or strike (or other labor stoppage or disruption); (i) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from Participant's participation in the Promotion or receipt or use of any prize; or (j) any other liability in connection with the Promotion (other than grossly negligent or intentional failure to conduct the Promotion in material compliance with the Official Rules).
8. CHANGES TO PROMOTION AND PRIZES.
(a) CORVEST may, with or without notice: (a) extend any time limit or waive any of these Official Rules where
a person might otherwise have been disqualified (without obliging CORVEST to relax the Rules on any further
occasion for that Participant or at all for any other person); (b) terminate or suspend the Promotion at any time
due to supervening circumstances reasonably beyond CORVEST's control; or (c) substitute any product or offer
deemed by CORVEST to be an appropriate replacement and of equal or greater value in the place of any of the
prizes (or any part of a prize).
(b) CORVEST reserves the right to cancel or modify the Promotion or these Official Rules if fraud, technical failures,
or any other factor reasonably beyond CORVEST's control impairs the integrity of the Promotion, as determined
by CORVEST in its sole and absolute discretion. CORVEST reserves the right in its sole and absolute discretion
to disqualify any Participant if CORVEST determines that such Participant has tampered with the entry process
or the operation of the Promotion or has acted in violation of these Official Rules or acted in connection with
the Promotion in an inappropriate, indecent, or obscene manner, as determined by CORVEST in its sole and
absolute discretion.
9. PRIVACY POLICY. Your right to privacy is something that CORVEST takes very seriously. As such, we offer
this explanation of what we do with the information we collect from you.
(a) When you provide us with your personal information (such as your name, address, phone number, email
address or company name), we will not dispense or sell it to any outside company for use in marketing or
solicitation efforts. We will maintain the confidentiality of your personal information and it will be used only in
connection with your customer relationship with CORVEST.
(b) Our intent in any email correspondence is to share information that will enhance your experience as a
CORVEST customer and to send such emails only those individuals who have chosen to receive such emails. To
discontinue receiving future communications, you may "opt out” at any time by emailing marketing@corvest.com
and requesting, in the subject line of the email, that your name be removed from our mailing lists.
10. DISPUTES. By participating (or attempting to participate) in the Promotion, Participant irrevocably agrees that: (i) any and all disputes, claims, and causes of action arising out of or in connection with such attempt or the Promotion, including without limitation any prize awarded, the administration of the Promotion, and the determination of prize recipients (each, a "Claim”), shall be brought exclusively in the state courts of Florida located in Pinellas County; (ii) Participant accepts and submits itself, himself, or herself to the exclusive jurisdiction and venue of the aforesaid courts in personam, with respect to any Claim, and waives any claim that such forum is inconvenient or any similar claim; (iii) any and all Claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Promotion, but in no event shall include attorneys' fees or other costs associated with such claim, judgment, or award; and (iv) under no circumstances will Participant be permitted to obtain any judgment or award for, and Participant hereby waives all rights to, punitive, incidental, and/or consequential damages, and any other damages, other than actual out-of-pocket expenses. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE LIMITATION ABOVE MAY NOT APPLY TO YOU. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, and the rights and obligations of the Participant or CORVEST in connection with the Promotion, shall be governed by the laws of the State of Florida, without giving effect to any choice of law or conflict of law rules (whether of the State of Florida or any other jurisdiction) that would result in the application of the laws of any jurisdiction other than the State of Florida. THE PARTICIPANT HEREBY AGREES IRREVOCABLY, KNOWINGLY, AND VOLUNTARILY THAT, IN ANY ACTION, PROCEEDING, CROSSCLAIM, OR COUNTERCLAIM BROUGHT IN RESPECT OF ANY MATTERS WHATSOEVER ARISING OUT OF OR IN ANY WAY CONNECTED WITH OR IN RESPONSE TO A CLAIM (AS DEFINED ABOVE), THE PARTICIPANT SHALL AND DOES HEREBY (i) WAIVE ALL RIGHTS TO TRIAL BY JURY AND (ii) WAIVES THE RIGHT TO CONSOLIDATE ANY ACTION IN WHICH A RIGHT TO JURY TRIAL HAS BEEN WAIVED WITH ANY OTHER ACTION IN WHICH A RIGHT TO JURY TRIAL HAS NOT BEEN WAIVED.
11. GENERAL TERMS AND CONDITIONS.
(a) The Promotion is void where prohibited by law.
(b) CORVEST's failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.
(c) All advertisements depicting the prizes and prize descriptions are illustrative rather than definitive. Reproduction
of any prize imagery does not imply any endorsement or association by the producer of that prize (or type of
prize) or by the owner of any brand associated with that prize (or type of prize).
(d) All instructions, rules, and conditions on any advertising or promotional materials (including notifications,
acceptance forms, and declaration forms) relating to this Promotion form part of the Official Rules. However,
in the event of conflict, the provisions of the Official Rules contained herein shall prevail over all such other
instructions, rules, and conditions.
(e) If the Participant receives a prize that CORVEST considers (in its sole discretion) to be major in the context of
the prize-pool as a whole, the Participant's name and county and state, together with the type of prize won, may
be publicized online or in print by CORVEST and may be used to otherwise publicize the Promotion.
